9. Enforcement and Remedies for Infringement
We actively monitor for unauthorized use of our materials. Each downloadable file contains digital watermarks and tracking identifiers linked to your purchase.
If you violate these Terms, particularly through commercial infringement or creating competing products, you agree that:
- Your license is immediately and automatically terminated without refund
- You will pay liquidated damages of $25,000 per infringing work, which the parties agree is a reasonable estimate of damages that are difficult to calculate
- You will pay all attorney's fees, legal costs, and expenses incurred in enforcing these Terms
- You will disgorge all profits derived from any infringing use
- We may seek injunctive relief to immediately stop infringing activity
- We may pursue all additional remedies available under the U.S. Copyright Act, including statutory damages of up to $150,000 per work for willful infringement
These remedies are cumulative and in addition to any other rights we may have at law or in equity.
